Just too play devils advocate if the mmar injunction is based on being exempt from the law of the CDSA. Now cannabis has been taken out of the CDSA then would that not make the mmar injunction a moot point seeing as cannabis is not classified as a drug by the cdsa?o_O

I don't think so, it will still need to be dealt with in court. Only Phelan can remove the injunction.

....and do you think that would require another court case?....I'm speculating here, but I would bet that the government can make some kind of application to have that injunction removed for the very reason growrock mentioned....they don't want people with big gardens becuase that puts it into the hands of children and the profits into organized crime...it cuts into their new business.

It's be cheaper to wait until they review it & then come up for a rationalisation that it's no longer needed because the rec market resolves the issue of supply.

It will still need to go to court. Government cannot set aside the injunction simply because they don't like it. It remains in full force until Phelan says otherwise. All the same reasons for the injunction still exist with legalization. Patients require access and $10 - $15/g is not realistic. I can see them making adjustments in the medical system, but I doubt they will ever reopen the MMAR battle. There are less than 20,000 of us so it will be easier and cheaper to just let us die off....
