Yes it passed recreationally. Dec 15 2016 will be officially legal & 1/2018 businesses will open for sale to the public. Give me some of what you have lol

Thanks for keeping up with these foot dragging.......I think I was one of the 1st suckers that got the license,buutt no place to use it.I'll be on hold until they give me a place in worcester to use it.:clap::clap::hump::hump::bigjoint:

Outdoor is allowed. As far as I can tell, it must be enclosed and secured. It can't be visible from public ways or from a height of 6.5ft at your property line.

Worcester got approved for a dispensary months ago. & pretty sure cultivation Center just got approved like 2 months back.

They do & it's pretty basic stuff. Not visible to the public, must be secure & have a security device.
Mine is nothing special, simple greenhouse... chicken wire around the inside walls ( used to keep out cats & woodchuck ) & a small lock on the door

I've only talked to 1 guy about it. But from what he said, it's not a simple thing to do. It takes a huge initial investment... 50 to 100k minimum. You need to have your shit together.

He already had investors & people from cali & Colorado who worked in the mmj field ready to work once he got approval.

Notice the end of Section 4 (2) about licensing fees ".....fees may be relative to the volume of business conducted or to be conducted by the marijuana establishment and shall not exceed:......"

Then the bill goes into a fee schedule. It seems the law was written so small commercial grows could be viable, with fees based on operation size. But we all know the state/ towns will charge the max, while saying is not enough. Already licenced MMJ facilities get first approval, the state has until the end of 2018 to license up to, I believe, 75 more MMJ facilities, which will also have Rec. approval. After Jan1 2019, the state will determine if more facilities are needed, based on demand. Here's an excerpt:


"....Section 4. The Cannabis Control Commission
(a) The commission shall, in consultation with the cannabis advisory board and
in accordance with chapter 30A of the General Laws, adopt regulations
consistent with this chapter for the administration, clarification and
enforcement of laws regulating and licensing marijuana establishments. The
regulations shall include:
(1) procedures for the issuance and renewal of licenses to operate
marijuana establishments;
(2) a schedule of application, license and renewal fees in an amount
necessary to pay for all regulation and enforcement costs of the commission;
provided however that fees may be relative to the volume of business
conducted or to be conducted by the marijuana establishment and shall not
exceed:
(i) For an initial application, $3,000;
(ii) For a license for a retail marijuana store, $15,000;
(iii) For a license for a marijuana product manufacturer, $15,000;
(iv) For a license for a marijuana cultivator, $15,000; and
(v) For a license for a marijuana testing facility, $10,000.
(3) qualifications for licensure and minimum standards for employment
that are directly and demonstrably related to the operation of a marijuana
establishment and similar to qualifications for licensure and employment
standards in connection with alcoholic beverages as regulated under
chapter 138 of the General Laws; provided that a prior conviction solely for
a marijuana-related offense or for a violation of section 34 of chapter 94C of
the General Laws shall not disqualify an individual or otherwise affect......"

You can listen to me. For every employee you have that handles the product, from cultivation to sales, it's another 5k per employee. It adds up fast.

Not to mention that's just the applications listed. No mention of facilities/ permits, town meetings / variences you need from the town. Then theres the equipment to grow,harvest,store & sell a product.
The people that keep your books... lawyer costs.
Plus a start up cushion to pay all these people before you actually have a product to sell.

Where are these figures coming from? Based on the MMJ dispensary laws? The licensing fees I listed are the law, there's nothing about fees based on employee numbers anywhere I've read. Extraneous fees imposed by state/ local government?

The big issue I see is they are trying to license large scale cultivation centers without provisions for home hobbyist growers to sell overages. Other than the "gifting" loophole. Was the guy you talked to involved in writing the bill? Seems they put alot of self serving provisions in, making it difficult for anyone not already in Mass's MMJ program to get involved. I meet most of the requirements, except I'm not already involved in Massachusetts MMJ industry, so I'm automatically disqualified from any permitting for, at least, 2 years.. total BS the MMJ people corned the market with legislation.

For the committee to be warying of big MMJ originally taking over they sure are making it apparent they are catering to big MMJ. I had heard talks of not allowing home growing because it will cut into weed barons $400/oz.

Or how about dont sell double the price of street dealers.

Each oz should be sub 200 and plenty money could still be made.

Id like to know their breakdown for reasoning $400/oz.

I don't think dispensaries can sell to people without mmj cards. If that's what yer asking. I CAN'T imagine that the state wont allow for rec dispensaries & rec cultivation centers. Especially with the increase in demand. I don't think they will allow for small scale growers to sell to distribution centers without going through local town offices.

& it's not really cornering the market. Regulations are in place for any1 that wants to start a small buisness, in any state. If we all want to operate legally, we should expect to follow the real rules. That being said, Mass has & still has some of the toughest standards across the country for everything. We're not taxachusettes for nothing.

If you're referring to the mmj guys having the only pot for sale in town.... the law for them got passed in 2012? They didn't start opening until last year. The rec lawmakers said we won't have to wait that long to buy... so it seems more than fair. Besides, medical caregivers have always been able to take "donations" for product. I don't see any reason why that should change. As long as you're getting re-embursed for your work, what's the big deal. Unless you go large scale.

Not to mention, you get a better, safer, more regulated product. I'm all for it.

If you look at the big picture, 2 years isn't that long for mmj places, if you're talking long term. I'm hoping they don't go out of buisness. That's 1 of the reasons I didn't take the job. Why grow for a medical facility , when I can finally do what they do.... except for myself, legally.

I've been trying to decipher it all, it seems as though the MMJ requirements are much tighter than Rec., probably because of the medical aspect of it. Do alcohol manufacturers need to pay for govt. mandate background checks and certs for employees? Do tobacco manufacturers? Idk, but I'm guessing no....The state should be concerned with end product safety only, not who I want to hire or their history, that's my problem. Make cultivators test samples for pesticides, molds, etc., before it goes to dispensaries and don't allow cultivators to sell direct to the public, other than that, the state doesn't need to know anything else.

As far as I'm aware, from everything I've been reading, already licensed Mmj dispensaries are allowed to start Rec. sale as of Jan 1 2018, but they need separate retail areas for MMJ/Rec. The state is going to license up to 75 (?) more MMJ dispensaries, which can also sell Rec, by the 4th quarter of 2018. After that the state will determine if more are needed based on demand There's NOTHING in the law regarding Rec. Only dispensaries, everything is tied to the existing/ future MMJ dispensaries.

There's literally thousands of high end, small scale, connoisseur growers, like myself, who saw this as an opportunity to be self employed, or at least supplement income, and we aren't even going to get a chance because the cost is out of the reach of most.

I've looked into starting my own buisness 3 different times, this is the only opportunity I've seen where I can, well should have been able to, do it with no outside investments. There's something wrong with our system when it essential stops people from becoming self employed unless you're already wealthy, or willing to go into debt and be on the hook to other.. neither of which I'm willing to do, or should have to, yay , Murica!

The reason for 400 zips is the greedy ass state wants 200$ of it, that's why the black market will NEVER die.
