Actually, that sapling was planted by myself as part of my natural reserve land improvement program. Techically I own pretty much this entire forest.

I've hired a mediator to assess how much he'll be paying me in damages.

Where is this forest? Also, I said PRIVATE property, as in land. A spear would be personal property. This same person's ancestors find a fertile valley several hundred years in the future and decided to grow some grain and vegetables etc.. Nobody else is occupying the land they have chosen. They work the land, making improvements to the piece of land and build some homes and animal barns etc. there.

Who owns THAT land? Those houses? That crop of food? Do the occupants have a right to consider that they "own" the places and things where they have mixed their labor with natural resources? They were there first and did not forcibly displace anybody.
