I would suggest that legality or illegality are man made constructs. Sometimes they align with sensible things, often they do not.

When did president Bush ever point out the fact that some Muslim countries execute gays? Was it when he was palling around and holding hands with King Abdullah of Saudi Arabia?

What do you think president Obama offhandedly mentioning "oh yeah, by the way, I know that law in Indiana is shit but they're killing gays over in Iran" would accomplish? Do you think, by comparison that makes us better somehow? Do you want to cause more diplomatic tension between Muslim nations with civil rights abuses and the US?

I think Obama is taking subtle shots at Christians. But he never takes any subtle shots at Muslims. Up to and including refusing to say the phrase "radical Muslims" or "Muslim terrorists". And yet there are definitely radical Muslim terrorist groups at work abroad, and in the US.

I don't think it had anything to do with religion, "When I hear less than loving words coming from Christians, I get concerned", that's what he said. How is that a "jab at Christianity" as Fox & Friends attempted to frame it?
