Can I sue children services?

Just a quick question, children services opened a case against my fiancee for physical abuse because her and our newborn tested positive for THC. How can they claim that is physical abuse? On the theory that THC withdrawal has physical symptoms? Do we have a legitimate case to sue them for wrongful accusation? I just want to sue them to make them and the uninformed public here in Marietta,OH a little better educated on the effects of marijuana. Any replies will be greatly appreciated.

unfortunately this will probably not turn out good for you

when youre pregnant, you shouldn't be tested positive for anything that COULD or CAN cause harm
im sorry but youre fiance shouldnt have been smoking while pregnant

while their are little effects on adult humans its probably not a good idea to be ingesting anything that alters you while pregnant

while im sure her child will be fine forever the fact remains that there is a serious stigma over marijuana in general but a lot in pregnancy and she shouldve loved her growing child more than to smoke a joint. because i would assume they were testing her for a reason child services dont just go random test new babies

Don't think that's a good idea. Quite frankly, we do not know the side effects of marijuana on pregnant women. Shit, we barely know the REAL side effects on non-baby bearing people. You'll get some attention for sure, but I doubt it'll be the kind your looking for.

this has been like the ONLY study on this subject, and it was done over 20 years ago.
medical science has come along way.

Ultimately we need to KNOW MORE. on the actual background of this.
Why was she tested in the first place?
child services doesnt just go around testing babies

im not trying to be mean but the harsh reality is that she is probably not a legal smoker considering she was being drug tested by child services.

my half sister smoked a ton during pregency and smoked cigs alot

and my nephew has severe autism and cant speak or write hes 10

my mom told me she smoked 2 cigarettes a day but i turned out okay



i guess its in moderation



but without derailing this thread more than i have i will say this


its impossible to sue the state unless something big happened


this does suck and i hope they dont take ur youngin away




the only thing is if she had a medical card before she was pregnant

no its not in moderation,. if youre pregnant youre growing a livingbeing anything you put into your body could potentially harm you child, why the heck would you do that?

Again the WHOLE story is not being told here.

the doctor told my mom to switch to menthols for crying out loud lol

totally agree, like i said im sure the child is fine, but there is defiantly more to the story than op is saying

We jus don't know that yet. We assume it to protect ourselves. Nothing wrong with that, it's human nature. But scientific research has not proven that bud is safe for pregnant women. (Probably because there has been no research. Can't prove something that isn't studied)

in moderation i mean like one bowl a month


my mom did smoke cigs when i was gearing to do the great escape

but im okay

now in the future when there's a little tytheguy in the making im gonna make sure she dont do shit lol


no "one glass of wine before bed" no "jay to make the problems go away"


and damn sure no "meth for when im depressed"


none of that shit :p

As far as suing child services, one could equate that to swatting a hornets nest. Every skeleton will come out of you and your finances closet. You will spend a fortune on attorneys just to get your parental rights back. Your infant could be placed in foster care during the court case.

im sorry ty i will disagree to the end of the world, and unfortunately you being young plays a part of this, as well as not being a woman, this is a growing baby in a womb, anything you put into your body does ultimately effect your child , whether it is aspartame in your yogurt to smoking 1 cigarette. anything that can affect a child should not ever be put into your body if you willingly do so
