but the physical violence steps it up to a class 3 felony sexual assault, regardless of gender.

that goes for colorado at least, where our senate candidate wants to charge a doctor with a class 3 felony if he provides an abortion to get rid of her rapist's baby (the rapist would likely get a class 4 felony sexual assault, a lesser charge than the doctor).
