if someone offers to sell you weed (unsolicited) and you ask if they are law enforcement..must they tell you if they are?

no, of course not schuylaar, cops can and will lie to you at anytime, and of course, there's no law saying that they must ever tell you the truth.. idk why or where the cops must tell you they're a cop thing came from as it obviously isn't based in reality..

but to answer your question, no, they don't have to tell you anything..

just re-read the op.. idk if a cop can walk up to you and ask if you want to buy any drugs as i'd imagine that might fall under entrapment, but obviously not 100% sure on that one.. i've always thought you had to ask a cop to actually sell you drugs in order for them to do so.. i'm pretty sure they can't break a law and try and catch you by doing so, ie, ask if you'd like to buy drugs...

lastly, w/e i've bought drugs from cops, 99% of the time they're not real drugs.. i'm sure there are times like an undercover or w/e selling real drugs, but ime, it's almost always fake drugs being sold by the popo..

I noticed that too and it threw me.
I almost think I remember cops helping a guy get explosive shit to commit an attack in oregon. Dont know the rules
but I think entrapment is more about pressuring you into something you wouldnt have pursued on your own.

So did someone sell you drugs and you are worried?
I do not think they are allowed to let their drugs back to the street so I expect
you would have been locked up then.

if the police officer introduces the element of criminal activity, then it is entrapment and you're a ok...that would be what racerboy is talking about, and what schuylaar's scenario addresses. An undercover cop can certainly lie to you--that's the premise of being under cover--his whole back story is a lie! But, he can't come up to you and say "hey do you want to do x illegal activity" and then arrest you for doing x illegal activity. He, can, however, sell you drugs/sex workers/etc. if you solicit them, or buy them from you (more common). neither of those situations is entrapment.
be easy,
:peace:

^^^when i say "you're ok" that means you'll have an affirmative defense, but you will still have to go through the court system...just to be clear...
so the accurate response to the question is, no the officer doesn't have to answer your question, but if you agree to buy you have been entrapped and thus can get out of it after-the-fact--the officer's evidence would be inadmissable "fruit of the poison tree"
there is no obligation for him to answer that truthfully, though.

completely agree char.. if they actually sold you real drugs, i'd think they'd not let you get very far with them and you'd get arrested the second they hand them to you..
and as to the asking if you'd want to buy drugs and entrapment, that's why i'm pretty sure you have to approach them and ask for drugs first, but like i said, i'm no lawyer, but i did stay at holiday inn express last night.. :D

Cops don't give a shit about the rules. Everything you think is based on media and TV coverage. Your rights come into play afterwards, at trial. I sold drugs in NYC in the 80s and your rights were golden until they didn't get their money. :)

"

[h=1]Is law enforcement incentivized against legalizing marijuana?[/h] [h=5]February 11, 2014[/h]
As Colorado was legalizing medical marijuana, law enforcement officials from California voiced their disapproval pointing at what they deemed failed medical marijuana laws in California. [McClatchy]
“I was told that we hadn’t learned anything from California – that you can’t do anything to regulate marijuana,” said Matt Cook, a retired Colorado Springs police officer who became the first director of Colorado’s Marijuana Enforcement Division, to McClatchy.
In Colorado, where pot retailers sell recreational marijuana, the state tags marijuana plants, inspects dispensary books and requires video surveillance of regulated pot deliveries and sales.
In California, law enforcement officials have forcefully opposed any legislation seen as legitimizing a marijuana industry. Their opposition is supposedly based on the belief that medical marijuana businesses are profiteering shams that were never authorized by California voters.
Marijuana advocates contend that police are unwilling to support marijuana legalization because they are too invested in pot policing through drug enforcement grants and revenue from seized houses, cars and property in marijuana prosecutions. California took in $181.4 million in revenue from seized property and money in marijuana cases from 2002 to 2012.
The Wall Street Journal reported last month that police in Washington were taking budget hits after marijuana was legalized for recreational use. Some police drug task forces lost 15 percent of funding due to decreased revenue from marijuana forfeiture cases."

Lie? Oh never
