The son of former B.C. MLA Judi Tyabji won’t be going to jail on a drug importation charge.
Kasimir Tyabji-Sandana pleaded guilty in Calgary Court of Queen’s Bench Monday to a charge of attempting to possess a controlled substance.
Justice Janice Ashcroft accepted a joint submission from defence counsel Ian McKay and Crown prosecutor Nick Devlin for a conditional sentence of just under two years.
Tyabji-Sandana must serve the first eight months of his sentence under house arrest at his Vancouver home and the second eight months under curfew.
He had been charged with importation in connection with a July 22, 2015, incident at his residence in Calgary, where he was living at the time.
Tyabji-Sandana, 30, was charged after Canadian Border Services Agency officers in Vancouver intercepted the package from China.
An amount of acetyl fentanyl was found in the package before it was removed and sent on to Calgary.
Acetyl fentanyl is a less potent derivative of fentanyl.
Tyabji-Sandana admitted receiving the package and opening it before members of the Calgary Police Service Tactical unit swept in.
He was scheduled to face a five-day trial beginning Monday before entering the guilty plea.
He had been on bail prior to his plea to the lesser charge.
His mother, Judi Tyabji, was the youngest MLA in the B.C. Legislature when she was elected in 1991.
She lost her seat in the 1996 provincial election after she and then-Liberal leader Gordon Wilson left the party after having an extramarital affair. They later married.
