Busted! My story, caught growing pot.

About 2 years ago, I was growing 6 marijuana plants in the basement of my home. It was the first time I had attempted to grow, and I didnt even really know what I was doing. I had only been a marijuana smoker for a year, and my dad had died a few months before the start of my grow. I was depressed and pot seemed to help me relax. The only reason I decided to grow was for my own use, I was very aware that it was illegal, and it was my stupidity, but I had no intentions of selling. In my opinion, I was addicted to pot, and I planned on smoking every bit of my grow.
Time passed by, and my plants were about 3 months into the grow, but they were not producing any buds. I figure it was becuase I had no idea what I was doing. I made a mistake and told one of my buddies [or so I thougth] about my grow. I knew he had grown in the past and I thought I could trust him. He said he could help me out, and we hauled a bunch of his equipment into my basement and made my grow a little better with a higher quality light, and growing buckets. My plants started to look healthier at that point.
A couple weeks later, I got a knock on the door at 4AM. I saw a police officer at the door and he saw me too. My heart skipped a beat, I was nervous and I decided to answer the door. The officer said that he was responding to a 911 call made from this residence. I replied that I am the only one awake and that no one could have possibly made the call. He said that they tried calling my house and no one answered, and that it was policy that he must search my home. I did not hear the phone ring. I replied again that I assure him nothing is wrong and that it is not necessary to search my home. Again I am nervous, and I think he noticed it. He then said that he isnt here for anything else and will be on his way after he searches my home. I asked him if he had a warrant, and his reply is "Do I need a warrant?". Well, I didnt know if he did or not.. if he is there for a 911 call how do I know? He then said, "I can smell marijuana and Im not going to worry about it, I just need to search the home to make sure it is safe". I began to panic and truly didnt know what to do. He asked me if I had pot, and I said yes. I just broke under the pressure. He came in and as soon as he was in my home he said, "now if you have plants growing its a different story." He was already in my home, what can I do now? I basically admitted it and he said "take me to the plants". He did no search at all for a 911 call. I 100% believe that he was tipped off about my grow by the same guy who gave me the light fixture.
He called for back up and they came to my house, took photos, and took me to jail. I was released within 24 hours on a "warrant pending". I was told that I can expect to be arrested again and charged with the crimes. They told me to search for my warrant online at a missouri courts website. I checked online for weeks, months, and then after a year I stopped checking so often. Well, 3 days ago I was pulled over while driving for expired tags, and I was told that I had a warrant for my arrest, saying it was for dangerous drugs.
I was taken to jail again, and was told I am being charged with a class B felony, and that I had a 20,000$ bond, which I paid 10% of and was out again within 24 hours.
I am scared. This is my first offense. The punishment for a class B felony in Missouri is up to 15 years in prison. I am a good person, I honestly would not harm a fly. I have court on the 29th of this month. Please, any advice you can give is greatly appreciated.

So sorry to hear, this is why it should be legalized...

But i ahte to say it, why the fuck did you open the door, if he had a fucking warrent to search he could have kicked the door down. But no point in saying shit like that now.

Just remember, NEVER TALK TO THE POLICE.

There will be plently of time to do it in court, they are never there to help you, never there to be nice, simply and clearly there for processing.

Hope you are out of the shit now or whatever, just want you to know, you are not alone, i have been in ( minor trouble ) with the police but thousands and thousands upon innocent people are convicted like you all the time, check out norml website ( even though im a uk citzen i know about it ) and most of all

dnt let this harm your mind, body n soul just stay healthy and stay kind man, dont let the fucking scum do anything real bad.

Its just a ride...

I feel for you man, but you broke some fundamental rules...that sucks.

they lied to you about the 911 call and they should have it on record with the dispach that they made no call and it was all a lie tiped off or not they need a warrant u can win it.. Good luck

they can lie to get you confess. Your story is like a friend of mines here in colorado.
same thing except why the cop came to the door.
he pleaded guilty and got a complete suspended sentence.
probation, classes, random ua and breathelizer! even though no booze was involved!
but, he did get off easy.
hope you get that lucky.

You've already said too much my friend. You need to get an attorney, a good one, and stop talking about the case right now! This is why you never let the cops into your house. Let them kick the fucking door in if they have a warrant. Seriously man, get a good lawyer, perhaps one who specializes in mj arrests. Check out NORML's website. They should have info on attorneys in your state. Best of luck my friend. :joint:

You need to spare no expense, even borrow money if you have to and get the best lawyer in town. I think a good attorney could make a case about a warrantless search and get it thrown out. Yes they can lie to get you to confess shit, but lying to search your house WITHOUT a warrant is a different story. Obviously there will be no record of a 911 call and obviously the cop could lie about saying that but a good attorney can get cops to fold. I definitely would fight it, if anything the more you fight the better plea bargain they will offer.

Never, and I mean NEVER let anyone know about your grow... (if you can't keep it a secret, how do you expect them to?)

Also, Never, and I mean NEVER talk to the police. For any reason, even if you're innocent.
Look through the peep-hole, if you see police.... walk away... You are not obligated to let them inside or speak a word to them, and if they have a warrant they are coming in regardless if you answer the door or not.

wow dude that sux and well now u kno that cops can fuk wjith ur mind so much they make u wave ur rights. wen he asked u if he needed a warrant u should have yes (that could have gave u time to cut ur shit down)and by law he had to go and get one

also ur going in for a 2nd degree felony ur lucky in texas for a 2nd degree felony is up to 25 years, and if u are a good person and do not have a record well ur lookin at about 2 to 5 years of probation. and thats only if u get a court appointed lawyer and if u pay for one then ur lookin at a better out come of ur case bro.

I had a similar experience with the police in my area, but I wasn't growing at the time. I was only 18 years old, still living with my parents, and very naive.

It was around 9:00PM, everyone was watching TV in the living room. The cops came by and said they got a call about a fight and wanted to search the house. Not knowing better, I let one officer inside, while the other waited outside. He did a very quick walk down the hallway, then came back outside. He apologized and said it must have been a prank call, then left.

My whole family was shocked and embarrassed. But we all agreed their story sounded like bullshit. We don't yell or scream like some families. In fact, on that day, my father and I had been in the back yard all day raking the leaves and cleaning up. And we are on really good terms with all our neighbors. We had lived in the area for over twenty years and have never called the cops, except for once, when my mother's car was stolen.

Now I'm older. I've read a few books to know that if a cop asks for permission, it means they're doing something they shouldn't be doing. I still wouldn't slam the door on their face, because that's just asking for trouble. But going forward, I get out of my car or house and close the door behind me when talking to them.

Since he was by himself it's his word against yours. Say he said he had a warrant then when you let him in he wouldn't show it to you and made an illegal search. Stick to your story and the evidence will be thrown out.

if you're a newb like me, get the advice from a site like this, places like this increase security(with a few common sense rules), especially when you see situations like this one

Get a good Lawyer it makes all the difference in the world.

If they don't think they can get you off they can bargain for a better sentence.
