I know the laws haven't changed and that it is nothing new for patients to be prescribed more based on their situation, but I've had a couple customers come in saying they went to the doctor and got recommended 12 plants instead of the usual 6? Anyone else know anything about this...... :leaf:

It is not unheard of to see people have higher plant recomendations then just the normal 6. the problem with this is that the affirmitive action provide by state law only covers 6 plants. IF you get in trouble for any reason you would have to go before a judge and prove that you actually need the extended plant limit. The law only covers you for 6.

I personaly live with a woman who has sever asma as well as being morbidly obese who need to have her medicine in edible form and her plant limit is higher then the 6 limit.
so I know what im talking about.

BadAndy pretty much said it, if you have more than the state number of 6, make sure you have a SOLID affirmative defense and a great lawyer. Solid being- Cancer, MS, HIV or other MAJOR documented serious illness. If they do drag you to court and you have the solid affirm, you request trial by jury and then you put the screws to the man, cause they're going to do it to you. Then you sue the shit outta the state for wrongful arrest, loss of employment wages, the works. After they seize all your stuff, you get out of jail on bail, your case goes to court and you get your chance to speak, your life is pretty much ruined. Getting a meaningful job again will be tough. I say turnabout is fair play. ;)

the black and white of the law says that if the doctor recommends more than it's legal. the doctor is recommending more not the mmj registry

and the reality of the law is that you will need to drag the 'Dr' into court along with a lot of other paperwork and provide an 'affirmative defense' for the higher count. this costs $$. folks can do as they please, but be aware of what you will need to do if you are popped with a higher count. if it's only a few extra, i doubt they will care as much. but try pulling the 40+ rec on them without being fairly obvious in your needs, then be prepared to battle to prove you need it.

ask yourself this as well: can I afford to plop down $5K-$10K in lawyer retainer fees, if I get popped? (and prepared to possibly spend upwards of $20-50K defending?)

I just did my re-new checkup and was rewarded, at my request, with an 18 plant count for a total of 9 flowers, 6 oz. posess. That was pretty damn cool. Gives me room to play around more!
