Had some issues with my card other day. Got a paper in mail saying about a charge i had yrs ago. I went into the department of health and spoke to lady in charge who was crazy nice and took care of everything for me. So today turned out nice for me. Dealing with state stuff is usually a pain in the ass thank god the lady in charge is understanding and will actually do her job on the spot rather than most state people who wont say anything in person.

I was told on phone to mail everything and wait up to 6 weeks to hear back. The person in charge did it all for me in 10min in person. If anyone ever questions anything just talk to her on phone or in person. You get way more answers rather than secretaries who answer phone.

Good to hear that everything worked out well. It seems that the people in charge are generally very caring about their job and willing to help out.

I must also give props to the DOH for their friendliness, professionalism and efficiency.

Cant believe I am saying that about a state service either lol

As a medical professional, though... I've seen a much different side of DOH...

Ricky, just curious, I'm headed to R.I. next year and have a record. I had a Hawaii card in 05-06. Does R.I. have stipulations against patients with records that would prohibit me from getting a card? Thanks::::

Ill be honest cause i have patients already and have caregivers card already... i have a possession charge from 3 yrs ago which started as a felony. Of course even though its was amended to simple possession the word felony shows up still. Our state sucks pretty much. I went in with proof it was amended and the clerks reading it wrong an saying it didnt say mist. On it so it was a felony when a simple possession is not felony charge. The main lady was extremely nice and bought it upstairs to lawyer to read and came right back apologized and gave me letter on the spot and i was on my way.

As long as no felony CONVICTION you will be fine. A mist. Possession charge will still allow you a card. If you do have a felony situation like mine was mail proof with app and highlight everywhere to make your point. If they deny you cause they misread papers then immediettly go in and talk to them. I was told to mail everything in and then reapple for another 75$. Instead i went in person and didnt pay a dime cause my notice was just recieved.

Nope. They denyed me cause they thought i had one. I actually dont have one and had to prove it to them in order for mine to be good again.

5yrs it says. After talking with the people at doh i doubt they look into the yrs part. They see world felony an skip to next app.... althoug you could fight it just as i did an prob get the card since it says 5yrs or older isnt looked at it.

So if u have a felony possesion with intent to distribute marijuana they won't let you get a med card?
If they proved you had intent to distribute you shouldn't be able to get a card imo. They don't want people selling their meds.

U can get one here in Denver Co just seeing how diff ur laws are than colorados good thing ur opinion don't matter!

I met up with multiple patients over this last week that wanted meds and a caregiver and they all were willing to give donations as long as its from a caregiver. Kinda dumb on ppl parts to still accept donations for meds just because someone has a card rather than only giving it to YOUR patient.... pretty much your allowed to grow it as a caregiver and still sell it to ppl legally as long as theyre approved by the state. No matter which was you say it your still selling it to random ppl just as long as they have the card. The system is retarded and is setup so you are basically selling it so eventually they can add their tax to it but when they want. Shouldnt matter about the felony thing since they WANT you to sell it, just to who they think should get it. At this point they giving it out for depression. Thats about 90% of country i bet.

Thats why i only give it to my patients when accepting donations.

I believe your referring to this section of the guidelines.

(f) A primary caregiver may receive reimbursement for costs associated with assisting a registered qualifying patient's medical use of marijuana.

That's not condoning sale really, It's only saying you can recuperate some of your growing costs (electricity, water, nutes, seeds, ect) from YOUR patients.

Backs that up:

(c) A primary caregiver, who has in his or her possession, a registry identification card shall not be subject to arrest, prosecution, or penalty in any manner, or denied any right or privilege, including but not limited to, civil penalty or disciplinary action by a business or occupational or professional licensing board or bureau, for assisting a
qualifying patient to whom he or she is connected through the department's registration process with the medical use of marijuana; provided, that the primary caregiver possesses an amount of marijuana which does not exceed twelve (12) mature marijuana plants and two and one-half (2.5) ounces of usable marijuana for each qualifying patient to whom he or she is connected through the department's registration process.



And this says a caregiver cannot receive a donation from a patient they are not connected with through the registry.

(m) A registered qualifying patient or registered primary caregiver may give marijuana to another registered qualifying patient or registered primary caregiver to whom they are not connected by the department's registration process, provided that no consideration is paid for the marijuana, and that the recipient does not exceed the limits specified in § 21-28.6-4

The felony thing makes perfect sense, seeing as how they want people to follow the law and if you have a felony you have proven that you cannot follow the law. They don't want people selling meds, but they also don't assume that people will foot the bill just to help each other out. Human nature has proven that that shit doesn't happen often.

@ ricky say it costs you $80 per month to run your lights, 10 a month for water and another 60 for soil, nutes ect. You should only accept $330 in donations total from your patients just enough to get back what it cost you. Time should not be calculated in, since the law says costs and time is not a cost in this sense. Your not expected to net any kind of profit. Best bet would be to cover your costs on a monthly basis with your patients then split the harvests based on the number of patients you have.

Actually it does since my opinion is kind of common sense. Take a closer look at Co laws..

You can get a card as a patient even if you have/had felonies in Rhode Island. You cannot get a caregiver card with a felony in Rhode Island.

Same seems to be the case in Colorado:

12-43.3-307. Persons prohibited as licensees (1) Alicense provided by this article shall not be issued to or held by:
(h) A person who has discharged a sentence in the five years
immediately preceding the application date for a conviction of a felony or
a person who at any time has been convicted of a felony pursuant to any
state or federal law regarding the possession, distribution, MANUFACTURING,
CULTIVATION, or use of a controlled substance; EXCEPT THAT THE LICENSING
AUTHORITY MAY GRANT A LICENSE TO AN EMPLOYEE IF THE EMPLOYEE HAS
A STATE FELONY CONVICTION BASED ON POSSESSION OR USE OF A
CONTROLLED SUBSTANCE THAT WOULD NOT BE A FELONY IF THE PERSON
WERE CONVICTED OF THE OFFENSE ON THE DATE HE OR SHE APPLIED FOR
LICENSURE;

pretty much verbatim of the Rhode Island laws.

I wasn't asking about being a caregiver dipshit and no Colorado is way diff than rhode island look how accepted mj is here compared to ur state shit there tryin to fully legalize it here were anybody that is at least 21 can grow and purchase it and no ur opinion don't matter to me maybe some one that you know! Which isn't me

Anyways, i understand about the felony thing. Didnt say i disagreed because then everyone would have a card and their would be no way to regulate it or know its being used under the correct circumstances. Although, it is getting twisted very often already. Everyone has their own guidelines lol.

Doesnt help that when you call the DOH and ask them a simple question about the law they say "we cannot help you interpret the law". I see many arrest in the future an lives ruined because state half ass-ed this whole thing. IMO anyways.
