Hwy patrol busted me! ={

Last night I was on my way toward the city with my friend for new years eve when my car starts pinging and suddenly dies on me. My engine is shot basicly which sucks and now we're on the side of the road 60 miles away from home. So I call AAA to come get me and as I'm on the phone with them Highway Patroll rolls up behind us. An officer came up to my passenger side and stuck his head in the window which was already open. He said he smelled pot, and I told him I don't smell anything. Then he said the other officer smells it too and that there's probable cause to search me and my vehicle. I told him that I don't consent to searches.. and my friend says the same we don't consent to unlawful searches. He said I smell pot, and I should just tell him where it's at so he doesn't have to dig my car apart. By this time I told him I had my medical card but he didn't really acknowledge it. He then had us get out and patted us down and took my medical card and asked what county I'm from I told him he said I'm in San Mateo county and it doesn't work here. And he told me my card isn't valid. I have Medicann and a recomendation. And there's a verification number for him to check but I still got charged with Posession Of less than one ounce of marijuana 23222 (b) vc is the code .
He also told me he's just one branch of the government, it's his job to find it. and when I go to court they will decide what they will do. And if they say I can have my medicine back I can go pick it up at his office.

I WOULD LIKE MY MEDS BACK AND I DON"T KNOW WHAT TO DO FOR THIS COURT DATE>> I SIGNED AN AGREEMENT TO SHOW> BUT ONCE I SHOW SHOULD I JUST BRIND IN ALL MY MEDICANN PAPERS AND MED CARD??

ahh what to do..

take that shit to court. Any judge with a half a brain will throw that case out before it even hits the courts.

First off, that pig had no right to be searching you. Plain and simple. Your car dies and you had broken no laws.

Fight and you will win, I promise.

you should have asked the cop first thing why his eyes were red. "You can't be high doing police work---what the fuck---who's your supervisor---etc." It would all be on the dash cam---a classic.

Yes Im really hoping the justice system will be fair, I plan on taking in my medications, (XANAX and Citilopram) for anxiety/depression. I hardly use either but it's some proof I really do have ailment which i use MMJ for.. along with that I'll bring in my Medicann ID card, and the Original Physicians Recomendation medicann gave to me which has the doctors signarue and statement saying I have been recomended to use MMJ.

Aside from that what else should I bring in? I want to fight this I feel my civil rights have been violated. I don't know why they don't recognise Medicann as legit.
I heard the other card you can get is optional through the citys health services however NOT mandatory for the use of MMJ. But this is the only card the cops seem to validate..

I don't really want to go to trial.... so I'm praying it will just be dropped... I'll go to trial if necessary but I don't want to worry about a lawyer or anything.
Does anyone know if medicann really isn't legit

did they finally get you do agree to a search or what?

if you did agree to it you could have some troubles. But if you didnt then it is an illegal search and seizure. The case will be thrown out.

Were you placed under arrest before the search?, if so were you told what you were being arrested for?
did you agree to the search?

You do not need a lawyer all you need is to be fully prepared with all the paperwork you can muster up. You need to go get copies of your medical records (the entire records) from your doctors as well as the evidence of prescriptions like you are talking about by bringing bottles. (empty bottles would be best so you are not rejected at the door by the security)

Bring every shred of evidence you can find. I don't know beyond that about legality of cards in your area but I am pretty sure you don't even need a card your doc just needs to have admitted mj MAY help your ailment that would sure help.

You can find the complete laws for mmj use online looking up your state, make sure you are in compliance with the law.

The reason I say you don't need a lawyer is because he won't be able to do anything you cant do yourself in this case and it will probably be a slam dunk to get it thrown out entirely.

Only if the judge doesn't throw it out and you have to actually go to trial is when you absolutely need to find a lawyer. (Which is unlikely to happen anyway)

I told the officer I don't consent to searches... and my friend chirped in and said it as well.. WE DONT CONSENT TO UNLAWFUL SEARCHES
he said he smelled pot and it was probable cause... then he had us get out and wait... he told us he was going to have us wait outside the vehilcle while another cop was coming. he also said he didnt want to search the car till his partner got there or something so we don't jump him while his back is turned

While we where outside the vehicle we where telling him it's cold, and dont consent to this. and my friend asked to sit in the cop car so while the cop searched my car they let us sit in their car.
and the cop had a microphone in the car and was listening to us. my friend at one point in the car said the cop was doing a thourough job of searching my stuff and when the cop came back he seemed so proud to know we said he was tearing up my car thourougly.

Medicann is not the state card but it fits the state requirements:

"this is a legal representation
of a medical marijuana recommendation written a licensed physician under
California Heath Safety code 1136.5"

i dont want to have to pay for a lawyer but if it doesnt get dropped on my first appearance i may consider it.. otherwise i plan to bring in what i have and hold my own case and hope for the best

Don't go into their house unprepared unless you want to get fucked in the ass by some bitch who couldn't get a date in high school because she was fat, had acne and was a total dork that escaped in books to validate her existence. They will rheem you out so bad you won't walk right for a month and all of this is over a misdemeanor. Get a lawyer.
