Murder charges issued after man accused of trying to steal pot plants dies

KALAMAZOO, Mich. — A man accused of beating the person trying to steal his medical marijuana was charged with murder in Kalamazoo.

Nathan Branham was charged with open murder after Michael McIntyre, 52, died in the hospital after police said he was hit in the head with a baseball bat Sunday.

Any decent prosecutor will say if he was so scared then why did he go out into the backyard instead of calling 911. He only called 911 after he went into the backyard with a baseball bat and beat the guy to death.

I'm not taking any sides on this. But I wouldn't kill anyone over some plants. I wouldn't hesitate to do what is necessary to protect myself or my family. But I'm not ready to kill over property. Especially some pot plants. And the guy was growing over the limit and looks like he was selling on the black market. People in legal states need to be thankful and follow the rules. He was breaking the law himself.

Anyway, bad situation all around. I'm sure the guy wishes he could get those few minutes back and do things differently.

Contrary to popular belief, you are NOT entitled to go after somebody on your property. You are also not entitled to use deadly force to protect property. You are ONLY allowed to use deadly force in self defense.

In the eyes of the law, walking out of your house into your yard to beat an unarmed man to death with a baseball bat is no different than doing the same exact thing in a Walmart parking lot.

that's why you don't call them, and make the first shot a good one to the jaw, so they can't be yelling and attracting the neighbors attention.
and people wonder why my flowers are so nice every year

It's a difficult situation.

A: If criminals knew the occupant could kill them free of charge.. would they be so willing to go into somebody's yard to steal?.

B: If you could kill people on your land free of charge.. define criminal. A guy retrieving his sons ball?.

If somebody was in my garden I would not be so willing to go out. You don't know the hand to hand training they have, nor what concealed weapon, lock the doors scare them off with lights or phone the cops. If they get in the house with your family, whole other story, I'd go for the kill and do the time.

my property is my property, stay off of it. i have a fence and signs that say as much. if i catch you in my yard, i ask why you're there, once, and i better like the answer, or you're going over the fence, and not feet first. if you resist me, as far as i'm concerned, that's enough reason to use whatever means it takes to get you out of my yard. i know i'm not a normal guy, i do have hand to hand training, and i almost always have at least a knife on me, and just a few feet away i have a handgun. so you're going to get out of my yard, or you're going to kick my ass, no middle ground.

I actually do that. Not to kids, though. Normally, kids are just retrieving their soccer ball or picking up a foamy dart.

I yell at people that walk their dogs around the neighborhood and decide to let them piss and shit in my lawn.

Those assholes get an ear full.

I've not had the problem for a while now. They don't even walk dogs down my street anymore. Word gets around, eventually.

My late uncle had an M1. After he passed, my cousin had agreed to sell it to me for 500 dollars. I told him I'd be up to pick it up that weekend. (This was about two weeks after the funeral when the estate was settled.)

The piece of shit called me on the Wednesday and said he couldn't wait so he pawned it for 250.

I contacted the pawn shop to try to pay it off, but of course it was not for sale.

I'll never forgive that sack of shit for that.

he didn't pawn it, he sold it, if he pawned it, you could have gotten the ticket from him and un-hocked it

I had my chainsaw stolen and bought a new one before I went out of state , A brand new Stihl that cost me $695 plus tax
My brother called me 6 months later that he sold my chainsaw for me and he boasted he got $400
I should have snuffed him when mom brought him home LOL

Ya not in my state sorry. You come on my property and try to steal anything you’re leaving with a few .223 holes in you. However I’ll shoot in the legs so they can live to tell the story and tell people how stupid they are. And yes my aim is that good I assure you.

I'm sure you're referring to castle doctrine. It applies only to your home (inside), office or auto in the event there is an intruder.

If I'm hiking and are simply cutting through your property and you shoot me, you are going to jail for a very, very long time.

If you kill me, it's 1st degree murder.

A kneecap will cause extreme pain. You don't want to kill them over some plants. If you wake up in the middle of the night with an intruder inside your house then definitely go for the shot to end all shots.
